Kasambahay Employment Contract

Made under Republic Act No. 10361 (Batas Kasambahay) and its Implementing Rules & Regulations

The Employer and the Kasambahay (each a “Party” and together the “Parties”) agree to the following terms, which are intended to comply with the Batas Kasambahay. Where any term falls below the minimum standards of the law, the law shall prevail.

1. Nature and place of work

The Kasambahay is engaged as a   (e.g., yaya, housekeeper, cook, general house help), working on a □ live-in   □ live-out arrangement at the Employer’s residence stated above. The detailed duties are set out in Schedule A.

The Employer shall pay the Kasambahay a monthly wage of  , which shall not be lower than the applicable regional minimum wage. (For reference, the NCR minimum is ₱7,800/month effective 7 February 2026 under Wage Order No. NCR-DW-06; rates vary by region.)

Wages shall be paid in cash, in full, directly to the Kasambahay,   (e.g., monthly / semi-monthly), without any deduction except those authorised by law or by the Kasambahay in writing. A pay record shall be kept by the Employer.

5. Thirteenth-month pay

The Kasambahay shall receive 13th-month pay equivalent to at least one-twelfth (1/12) of the total basic wage earned in a calendar year, payable on or before 24 December, or pro-rated if employed for less than one year.

6. Leave benefits

After one (1) year of service, the Kasambahay is entitled to five (5) days of paid service incentive leave per year. Unused leave is not cumulative or convertible to cash unless the Parties agree otherwise.

7. Mandatory government benefits

The Employer shall register the Kasambahay with, and remit contributions to, the SSS, PhilHealth, and Pag-IBIG. If the monthly wage is below ₱5,000, the Employer shall pay the full contribution; if ₱5,000 or more, the Kasambahay’s share may be deducted from wages and remitted by the Employer.

8. Board, lodging and basic necessities

For a live-in arrangement, the Employer shall provide, free of charge: at least three (3) adequate meals a day, humane sleeping arrangements, basic necessities, and access to basic emergency medical attention. Reasonable access to means of communication shall not be unreasonably withheld.

If the Kasambahay is below eighteen (18) years of age, the Employer shall afford the opportunity to receive at least elementary and secondary education, and the work schedule shall not interfere with such schooling.

10. Conduct, confidentiality and privacy

Both Parties shall treat each other with dignity and respect. The Kasambahay shall keep the Employer’s household matters confidential. The Employer shall handle the Kasambahay’s personal information lawfully and only for legitimate employment purposes, consistent with the Data Privacy Act (RA 10173).

11. Termination

The Kasambahay enjoys security of tenure and shall not be dismissed except for a just cause set out below or upon proper notice. Unjust termination entitles the Kasambahay to the remedies provided by law.

By either Party with notice: Either Party may end this Contract by giving at least five (5) days’ prior written notice. Upon separation, all earned wages and benefits shall be paid in full, and the Employer shall issue a Certificate of Employment within five (5) days of request.

By the Employer for just cause (no notice required): serious misconduct or wilful disobedience; gross or habitual neglect of duties; fraud or wilful breach of trust; commission of a crime against the Employer or the Employer’s family; or other analogous causes.

By the Kasambahay for just cause (no notice required): verbal, emotional or physical abuse; inhumane treatment; a crime committed by the Employer against the Kasambahay; violation of this Contract; or other analogous causes.

12. Prohibited acts

The Parties acknowledge that the law prohibits: employment of anyone under 15 years of age as a Kasambahay; debt bondage; withholding of wages; charging excessive deposits; and trafficking or any form of forced labour.

13. Dispute resolution and governing law

Disputes shall first be brought before the Barangay for conciliation, then to the DOLE for wage and benefit matters, or the NLRC for illegal dismissal or contract violations. This Contract is governed by the Batas Kasambahay (RA 10361), its IRR, and the laws of the Republic of the Philippines.

14. Entire agreement

This Contract, together with its Schedules, is the entire agreement between the Parties and supersedes any prior verbal or written understanding. Any amendment must be in writing and signed by both Parties.

15. Severability

If any provision of this Contract is found invalid or unenforceable, the remaining provisions shall continue in full force, and the invalid provision shall be read down to the minimum standard required under the Batas Kasambahay.

16. Copies, language and effectivity

This Contract is written in a language understood by both Parties and is executed in two (2) original copies, with each Party keeping one signed copy. A copy may be registered with the Punong Barangay of the locality. This Contract takes effect on the start date stated in Clause 2.
