This document governs your access to and use of the Pinoyaya mobile application and website (“Pinoyaya”, “we”, “us”, “our”), operated by Pinoyaya Social Welfare Services. By accessing or using Pinoyaya, you agree to these Terms of Use and our Privacy Policy.
1. About Pinoyaya
Pinoyaya is a digital marketplace operated by Pinoyaya Social Welfare Services that connects families with independent caregivers, including nannies, babysitters, and housekeepers (“Caregivers”).
Pinoyaya does not employ caregivers, does not act as an agency, and does not supervise, control, or guarantee caregiving services.
2. Eligibility
- You must be at least 18 years old to use Pinoyaya.
- Families must have legal authority to hire caregivers.
- Caregivers must provide accurate personal information and complete identity verification where required.
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Account Registration & Security
- Registration requires a valid mobile number verified via OTP (one-time verification).
- Users may optionally add email or social login for convenience.
- You are responsible for maintaining the confidentiality of your account.
- Phone numbers are never displayed to other users.
4. Caregiver Verification
- Caregivers must complete identity verification through a third-party provider (e.g., Veriff).
- Verification confirms identity only and does not guarantee skills, experience, or suitability.
- Unverified caregivers may be restricted from search visibility or job applications.
5. Marketplace Disclaimer (Important)
Pinoyaya:
- Does not conduct in-person interviews or background checks
- Does not supervise caregiving services
- Is not responsible for the conduct, performance, or outcomes of caregiving arrangements
Families are solely responsible for interviewing, selecting, supervising, and compensating caregivers in compliance with applicable laws.
6. Payments & Access Passes
- Paid access is required to:
- View full caregiver profiles
- View job applicants
- Start or reply to chats
- Send job offers
- Access is provided through time-based access passes.
- Payments are processed exclusively via Apple App Store or Google Play.
- Access begins immediately after payment confirmation.
- No refunds are provided for partially used access periods unless required by law.
7. Chats & Communication
- All communication must remain within the app.
- Sharing phone numbers, emails, or external contact links is prohibited.
- Chats unlocked during an active access period remain visible after expiry.
- Starting new chats requires an active access pass.
8. Reviews & Ratings
- Reviews may only be submitted after a completed job.
- Reviews must be honest, factual, and respectful.
- Pinoyaya reserves the right to remove reviews that are fraudulent, abusive, or misleading.
9. Prohibited Activities Disclaimer (Important)
Users may not:
- Create false or misleading profiles
- Harass, abuse, or discriminate against others
- Circumvent in-app payments
- Solicit off-platform contact
- Engage in illegal or unsafe activities
Violations may result in suspension or permanent removal.
10. Data We Collect
We may collect:
- Name, age, and profile details
- Mobile number (for verification)
- Email (if provided)
- Approximate location (city or distance)
- Reviews, ratings, and interaction data
- Payment confirmation records
We do not collect background GPS tracking data.
11. How We Use Data
Personal data is used to:
- Match families with caregivers
- Enable communication
- Maintain platform safety
- Improve services
- Comply with legal obligations
12. Data Sharing
Data may be shared only with:
- Identity verification providers
- Payment processors
- Cloud hosting and analytics services
- Legal authorities when required
Pinoyaya does not sell personal data.
13. Data Retention
- Data is retained only as necessary for operational and legal purposes.
- Users may request account deletion, subject to regulatory requirements.
14. Data Protection Officer (PH Compliance)
In compliance with the Philippine Data Privacy Act, Pinoyaya Social Welfare Services has appointed a Data Protection Officer.

15. Children & Safety Disclaimer
Pinoyaya does not supervise childcare activities and does not guarantee caregiver performance or suitability.
Parents are responsible for assessing, supervising, and ensuring the safety of children under their care.For privacy-related inquiries or complaints.
16. Limitation of Liability
To the maximum extent permitted by law, Pinoyaya Social Welfare Services is not liable for:
- Personal injury
- Property damage
- Financial loss
- Disputes between users
Use of the platform is at your own risk.
17. Termination
Pinoyaya may suspend or terminate accounts that violate these Terms, without prior notice.
18. Governing Law
These Terms are governed by the laws of the Republic of the Philippines.
19. Changes to These Terms
Pinoyaya may update these Terms at any time. Continued use of the platform constitutes acceptance of the updated Terms.
